Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by AiSrcleo Digital Solutions ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Services

AiSrcleo Digital Solutions provides cloud-based email delivery, marketing automation, and digital communication services accessible via our platform at https://aisrcleo.my.id. Services include but are not limited to transactional email delivery, bulk email marketing, omnichannel notification management, analytics reporting, and API access.

3. Account Registration

• You must provide accurate, complete, and current information when registering.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• You must be at least 18 years of age to use our services.

4. Acceptable Use Policy

You agree NOT to use our services to:

• Send unsolicited commercial email (spam) to recipients who have not given explicit consent.
• Send emails containing malware, phishing content, or deceptive information.
• Violate any applicable laws, including Indonesian Undang-Undang ITE (UU No. 11/2008) and anti-spam regulations.
• Harvest email addresses without authorization.
• Impersonate any person or entity or falsely claim an affiliation.
• Send content that is defamatory, obscene, threatening, or harassing.
• Engage in any activity that degrades platform performance for other users.

Violation of this policy may result in immediate suspension or termination of your account without refund.

5. Email Sending Compliance

You are responsible for maintaining clean, permission-based email lists. You must:

• Include a valid physical mailing address in all marketing emails.
• Provide a clear and functional unsubscribe mechanism in every commercial email.
• Honor opt-out requests within 10 business days.
• Comply with CAN-SPAM, GDPR (for EU recipients), and applicable Indonesian regulations.

6. Payment Terms

• Subscription fees are billed monthly in advance.
• All prices are in Indonesian Rupiah (IDR) unless otherwise stated.
• Payments are non-refundable except as required by law or stated in our refund policy.
• We reserve the right to modify pricing with 30 days' prior notice.
• Overdue accounts may be suspended pending payment.

7. Service Level Agreement (SLA)

We target 99.5% platform uptime monthly, excluding scheduled maintenance windows. In the event of downtime exceeding SLA thresholds, service credits may be issued upon request. Credits are the sole remedy for downtime events.

8. Intellectual Property

All platform software, branding, documentation, and content provided by AiSrcleo Digital Solutions are owned by us and protected by Indonesian and international intellectual property laws. You retain ownership of content you send through our platform. You grant us a limited license to process your content solely to provide the services.

9. Limitation of Liability

To the maximum extent permitted by Indonesian law, AiSrcleo Digital Solutions shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities, arising from your use of the services. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

10. Termination

Either party may terminate the agreement with 30 days' written notice. We may terminate immediately for material breach of these Terms. Upon termination, your access will cease, and data will be deleted per our data retention policy.

11. Governing Law

These Terms shall be governed by the laws of the Republic of Indonesia. Disputes shall be resolved through the courts of Sidoarjo, East Java, Indonesia, or through amicable settlement.
